Plaintiff are partners doing business under the firm name of Twin City Junk Company. sued the def. for $1,900.00 for in 1931, the pla. were the owners of a truck on which they held an insurance policy with the defendant against accidents, including fires. The truck was destroyed by fire and its actual value at the time was the $1,900.00, which the policy should cover, but the defendants are refusing to pay. Suing for an additional 25% penalty provided by statute. |

McCrowell says if he ever bought from store, he always pd for what he got; only other dealings w/Betterton: purchase of grindstone in 1860 (for which he pd). Merman had paid off every month and asked if rent could be dropped to $35 a month temporarily due to the Depression, which J.M. Barker Jr. agreed to. He later informed Pla. that he rented property to someone else even when Pla. offered to pay the $120 unpaid balance. Pla. sought certiorari against def. for possession of land from their earlier unlawful detainer case. |

The transaction is a bit more complicated, as it also involved an obligation owed to Fitzgerald by Sally Cox & William K. Hulse, and a promise to convey to Fitzgerald an 87-1/2 acre tract of land belonging to John Cox (dec). Ultimately, court dismissed suit & Fitzgerald appealed to SC. |

In 1934, the defendant entered into a contract with Maymead K. Crowe, the plaintiff's daughter, for a policy worth $500 payable to the plaintiff. M. K. Crowe later became completely disabled by a disease while under the policy, later dying in 1937. Due notice of her death was provided for the defendant, but they refused to pay the benefits from the policy to the plaintiff who now files to recover the funds plus 25% statutory penalty. Includes appeal. |
