The Unicoi Funeral Home of Erwin, Tennessee executed to the plaintiff in error, a chattel mortgage to secure the payment of a note in the sum of $500. The note was not paid and the plaintiff institute replevin proceedings and gained control of a large stock of inventory. At the same time, the Unicoi Funeral Home was also indebted to the defendant who later brought suit against the plaintiff, alleging she was indebted to him by violation of the Bulk Sales law. |

The plaintiff was riding in the bed of a truck owned and operated by an agent of the defendant, when a low hanging telephone wire caught the plaintiff on the back of the neck and threw him from the truck. He sustained serious and permanent injuries and the plaintiff alleges that the defendant should have known that their wire was in disrepair. Suing for damages in the sum of $2,999.00. |

Because Guaranty Trust Co. failed to pay its note to plaintiff when due, plaintiff became owner of note made by defendant. Court ruled in favor of plaintiff for $1236.02. Defendant appealed. |

Thomas owned lot on North Main St. in Erwin, TN on which he erected 1-story river rock bungalow as his residence. Dispute arose w/Town of Erwin when ditch running on side of Thomas' lot overflowed & flooded his basement, which Thomas claimed resulted from Town's actions in regrading nearby Elm & Maple Streets. Jury ruled in Thomas' favor, awarding him $650. Witnesses: Roy Morris, George Oakley, G.K. Painter & wife (all neighbors), O.E. Bogart, A.R. Plaintiff filed bill to rescind a conveyance made by Jonas Irish, deceased, to defendant James Shields for a large tract of land 5 miles from Knoxville on the Clinton Pike worth $5,000. Irish claimed that Shields' agent convinced Jonas, through fraud, to convey the land in exchange for a 24 acre tract of land 12 miles from Knoxville not worth more than $300, 200 acres of will stump land in Michigan not worth more that $600, and a $950 mortgage. |

Plaintiffs were employed as partners and building contractors in said county, who employed them to construct all the brick walls of a certain school building. Plaintiffs furnished the materials, which amounted to $362.63. The building was then consumed by a fire and the defendants collected insurance on the building, but never paid the plaintiffs for the material bought under contract. |

In 1907, the defendant entered into a contract with the Bristol Telephone Co. who agreed to furnish switchboard connections to the Def. subscribers for a dollar per call for a ten year term. The contract was never expressly renewed, but the parties continued the same service. After 1924, the defendant was indebted to the plaintiff for $318 for calls connected, reported at 212, but the Pla. believes the number is higher. The defendant failed to settle their debt on the account. |

On 5 Aug. 1930 Dr. Bowery took out a $10,000 life insurance policy with Southern States Life Insurance Co. which was later taken over by the deft. which has refused to pay the plntff.'s claim. Plntff. filing suit for $10,000 plus interest & penalties. Deft. argues it has no liability as Dr. Bowery died by his own hand. It is suggested that he was heavily in debt. 2 Folders. |

In addition, a right of way to a spring on the def. land was included in deal. The plaintiff built fences and dug ditches to improve the land. Plaintiff sued when defendant rescinded the agreement. |
