The plaintiff is claiming the possession of one 1930 Dodge Sedan automobile by virtue of its alleged retention of title contract and that the defendant was claiming the right to the possession by reason of a lien upon said automobile.

Plaintiff, who holds a $1500 insurance certificate with def.., is sued def.. to recover this amount. Plaintiff states that he is permanently disabled & unable to work due to "bronchial trouble, lung trouble, tuberculosis of the lungs" & other diseases. He has proven his illness & disability to the deft. in accordance with the terms of the policy, but deft. has refused to pay. Deft. argues that the claim was denied because the policy had not been continuously in force for 1 year as required.

View Entry 1842 David J. Wilson v. Landon C. Hoss, admr. of William L. Wilson, dec. Washington Estate Dispute

David asked court to rescind administration granted to Hoss on TN portion of William's estate & grant administration to David, Wm's brother & creditor. Wm died in Mississippi; Mississippi admr: James Carothers. Wm's widow: E.J.B. Wilson. Transcript references slaves as part of estate & litigation re: such slaves then pending in Chancery Court. Court refused to rescind Hoss' letters of administration & David appealed.

View Entry 1938 Elbert N. Keys v. Personal Finance Company Washington Mortgage Dispute

Plaintiff executed a chattel mortgage on his pick-up truck to Personal Finance Company. The truck was attached when a judgment went down in Greene Co. in favor of C. W. Smith & against Keys. Personal Finance replevied the truck & sold it without giving Keys prior notice as required by law.

View Entry 1820 Hurr Mills v. Elias Bowman, John Bowman and Quinn Morton Washington Land and Title Dispute

Mills purchased a 640 acre tract of land in Anderson County on Brushy Fork of Poplar Crk, E. Bowman loaned him $60 for security. When the term of stay ended, Bowman took it to court and had the land forfeited to him and conveyed it to his son, J. Bowman. Bowman then sold the land to Quin Morton

This case involved taxation disputes between the two parties. Horton, Gildersleeve & Co. believe they are being taxed at a unlawfully rate for some farming land that they own.

View Entry 1856 Henry Baker v. David H. Proffit Washington Land and Title Dispute

Dispute over piece of land that bordered both Baker's land & Proffit's land, bordering Mallinee's Branch (creek). After King built dam, it threw water on old road so Baker could no longer cross it, so Baker removed fence he had previously built on land & built a new road. Proffit then built fence on the land. Two mistrials, then 3rd jury ruled in Proffit's favor. Exhibits include 2 plats showing disputed land. Witnesses: David Sullenbarger, Isaac Stephens, Samuel Sherfey, Elijah Close, others.

View Entry 1932 Hershel Burton v. Prudential Life Insurance Co. & Miller Brothers Co. Washington Insurance Disputes

Plntff. a former employee of Miller Bros. & holder of a group insurance policy that will pay $2000 should he become totally & permanently disabled due to illness. Plntff. avers that he is now disabled under the provisions set forth by the policy, but Prudential has refused to pay his claim, forcing him to seek legal recourse. Plntff. asking for $2000 plus 25% penalty for non-payment of his claim. Deft. argues that plntff. is not sufficiently disabled to meet the contract's criteria.

View Entry 1871 Isaac Broyles v. George W. Nelson, admr. of Bird W. Brown, dec., et al. Washington Estate Dispute

Suit states that Brown's widow owed Broyles $54. Brown's widow signed note agreeing to pay bill, but still did not settle estate. Broyles sued estate for debt due on account. Account represented services Broyles performed for Brown (hauling & thrashing wheat, hauling wood), & also items purchased from him (wheat, flour). Broyles' store known as Broylesville.

View Entry 1857 Joseph R. Simpson v. Ephraim Murrey Washington Election Dispute

Two suits tried together, the object of both being to ascertain which party is lawfully the surveyor of Washington County & therefore entitled to books & papers of that office. Madison Booth elected surveyor in May 1852, but resigned in August 1855. At special election, Ephraim elected to fill out Booth's unexpired term. At May 1856 election, Ephraim & Joseph were both candidates, but Joseph won. Nevertheless, Ephraim appeared at July term of court & had his surveyor bond approved. Ephraim won.

The plaintiffs are heirs of Adaline Simpson, dec. who was the owner of a 200 tract of land in Wash. Co. The plaintiffs allege that a new survey by the defendants has challenged the traditional property lines. Exhibit is a hand dawn map.

View Entry 1845 John Den, lessee of Jeriel Dodge & John Bowman v. John Hodges, et al. Washington Land and Title Dispute

Add. Defs: Howell A. Hodges, Jesse Duncan. Dodge & Bowman leased to Den (to farm) several tracts of land near or on Watauga River & Holston River, including tract with ferry formerly known as Duncan's Ferry. Den ejected & filed suit for $500 damages. John Hodges lived on land. Duncan was "an old man" who "had no family" & lived with John "as one of his family." Howell (John's son), lived on & farmed another part of the land. Dodge & Bowman died while suit pending; their admrs. continued the suit.

View Entry 1852 John Den, lessee of Henderson Clark v. Montgomery Stuart, admitted to defend in lieu of Thompson Stuart Washington Land and Title Dispute

Clark leased to Den 20 acres on Nola Chuckey River (including small island & fish trap), which land Clark claimed through July 1842 TN grant to him (#24711), which Stuart also claimed through Oct 26, 1786 NC grant to Cornelius O'Neal (#748). After trial began, pla. replaced original def Thompson Stuart with Montgomery Stuart. Land at issue surveyed by county surveyor Madison Booth. Jury ruled in Clark's favor.

View Entry 1932 John H. Spears v. Dixie Fire Insurance Company Washington Insurance Disputes

Plaintiff had an insurance policy with the defendant for loss by fire up to $1,000.00. Fire later destroyed lumber on yard, in sheds, and a warehouse owned by the plaintiff. The defendant refused to pay the policy and the plaintiff is sued for $3,000.00 for principal and interest plus a 25% penalty for failure to pay within the statutory period.

This suit was instituted by Dr. A. H. Grigsby against this insurance co. to collect the sum of $500.00, which plaintiff alleged he was entitled to by reason of injuries, sickness suffered by him while carrying a sick & accident insurance policy with said insurance co. Dr. Grigsby suffered from eczema. His claim was that he suffered from occupational dermatitis caused by use of Novocain.
Case appealed to TN Supreme Court.
