Dispute over piece of land that bordered both Baker's land & Proffit's land, bordering Mallinee's Branch (creek). After King built dam, it threw water on old road so Baker could no longer cross it, so Baker removed fence he had previously built on land & built a new road. Proffit then built fence on the land. Two mistrials, then 3rd jury ruled in Proffit's favor. Exhibits include 2 plats showing disputed land. Witnesses: David Sullenbarger, Isaac Stephens, Samuel Sherfey, Elijah Close, others. |

Plntff. asking for $2000 plus 25% penalty for non-payment of his claim. Deft. argues that plntff. is not sufficiently disabled to meet the contract's criteria. |

Two suits tried together, the object of both being to ascertain which party is lawfully the surveyor of Washington County & therefore entitled to books & papers of that office. Madison Booth elected surveyor in May 1852, but resigned in August 1855. At special election, Ephraim elected to fill out Booth's unexpired term. At May 1856 election, Ephraim & Joseph were both candidates, but Joseph won. Nevertheless, Ephraim appeared at July term of court & had his surveyor bond approved. Ephraim won. |

Dodge & Bowman leased to Den (to farm) several tracts of land near or on Watauga River & Holston River, including tract with ferry formerly known as Duncan's Ferry. Den ejected & filed suit for $500 damages. John Hodges lived on land. Duncan was "an old man" who "had no family" & lived with John "as one of his family." Howell (John's son), lived on & farmed another part of the land. Dodge & Bowman died while suit pending; their admrs. continued the suit. |
