Dyer was a minor under the age of 21 and brought suit through next friend M. M. McCaslin. Dyer was married to Johnnie Dyer, an employee at the dfnt. Corporation. On Dec. 11, 1923 he "fell into an open vat of hot water and was almost entirely submerged therein, where in and where by he was hurt, wounded, and scalded fatally" causing his death on Dec. 12. |

They fulfilled the contract & were paid for the first car load, but defendant refused to pay the $247.50 due them for the second car load. They are suing to collect this amount, interest & cost. |

The deceased was "a negro boy about 22 years old who had been afflicted for many years with Epilepsy." As he grew older, his seizures became more frequent. Testimony indicates that his father had been warned many times to keep his son away from the railroad tracks. In June 1898, R. L. wandered onto the tracks, had a seizure, and was run over by a train. |
