Owen & wife Margaret executed mortgage to E. H. Hatcher, guardian of M. A. Barnett, on house & lot on Main St. in Franklin to secure $750 note. Later, Owen & Hatcher conversing near public square in Columbia. Hatcher said interest was past due; Owen said he'd forgotten, offered it to pay it then; Hatcher refused, said he was going to resign as guardian & ward's mom was thinking about qualifying. Hatcher remained guardian, but pla. (judgment creditor of Owen) sued to reach Owen's equitable interest. |

They had purchased a tract of land from the Court on a credit of $3480, more than they were entitled to. Court required defendants to give a bond to refund the excess.
