Plaintiff filed bill after Baird told the company the road was now designated a shun pike and was going to have it laid off without due notice, which also damaged the road and tolls. Susan Tracy sued her husband, James Tracy & Duncan Johnson. At the time of their marriage, in the 1840s, Susan was entitled to a small fund, which came from the estate of her father John Lawrence. James was the trustee, not the owner of this fund, but if land was purchased with the money, he could have rights to the land. James invested part of the money in purchasing a slave. Land was then purchased, but James claimed soul ownership. |
