Plaintiff sued to recover $1650 in lost payments, plus interest. Until Feb. 1930 he received $50 per month from his insurance because of a disabling gunshot wound to his shoulder, suffered 5 Dec. 1928. His insurance premiums were also waived. In Feb. 1930 deft. discontinued the payments & declined to further waive the premiums on grounds that plaintiff was no longer disabled as defined by the terms of his policies. Hackworth argues that he is capable of small tasks only & is still disabled. See ET1553 |

Plaintiff was owner of a lease of 250 acres of coal lands at Coal Creek and was involved in the mining and selling of coal in a store. Plaintiff leased land from defendants and entered into partnership with them to form the Knoxville Coal Co. Plaintiff transferred assets and gave defendants $6,000.00. Pink's son Luther was killed while working for Pruden Coal & Coke Co. Luther's stepgrandma Mattie sued to recover compensation for his death. Pink was going to sue for same but, instead, agreed w/Mattie that each would get 50% of such compensation, but Mattie then failed to pay Pink his share; this suit ensued. Mattie was widow of Thomas Hutson, Luther's grandpa, and the Hutson's raised Luther, whose mom died when he was a baby. |

Willis accepted a deposit of $1537.39 from Charles F. Eager. At that time, Willis knew that the Knoxville Banking & Trust Company was insolvent. The argument is based on the interpretations of the Bank Law of 1911 and the Constitution. This law states that it is a felony to accept a deposit, as an officer of a financial institution, known to be insolvent. |
