Add. Plaintiffs: John Skillern, Henry Miller. Add. Def: James A. Whitesides (later dropped from case). The 2 Skillerns, Miller & Smith formed partnership to speculate in mountain lands, including 10,000 acres in Hamilton County. Per consent of partners, Smith went north to try to sell land & did sell land to Dr. Joseph Evans of New York, in exchange for land in Village of Jamaica, Long Island, NY. Plaintiffs sued Smith to account for proceeds of sale.

Dispute over land & slaves. Plaintiff, citizen of Alabama, purchased from Edward Seabourne (non-party) Marion Cty land in which Defendant allegedly had a claim. Plaintiff says Defendant & Seabourne acted fraudulently in their dealings with Plaintiff. Jones also says Pryor fraudulently caused judgments against Jones to be levied against slaves Jones then owned. Slaves named: Sylvia, age 24, Lafayette, age 6, Alexander, age 3, & Elizabeth, age 9 mos. Children of Sylvia: Henry, age 2-1/2, Isaac, age 1.

Bird bought 585 acres from Carnes. Dispute arose over boundary lines on the land. Then Carnes sued Bird on the purchase money note. Bird filed this suit to enjoin Carnes from prosecuting that suit until dispute resolved. Bird died while suit ongoing & James S. Pankey was appointed his administrator.

Add. defendants: Catherine L. Simpson, Stephen Hick & wife Elizabeth, & B. Feagans. Defendants Catherine & Elizabeth are formerly Feagans. S. Hick is the administrator of Richardson Feagans (dec.). Elizabeth Feagans is the deceased's widow.

Additional Plaintiffs: J. C. White, Francis White, Thomas White, Alexander White, Newton White, Addison White, Matthew White, John M. Humes, Jane Elenor White, Henry Humes and heirs at large of James White, dec. Additional Defendants: Albert S. Lewis, Reynolds S. Ramsey.

Additional defendants: Benjamin H. Bridgman, John S. Lee, and William Skillern (Henninger's securities). Henninger, former clerk and master of the Chancery Court at Pikeville and special commissioner in the cause of H.B. Tollett et al. v. E.Y. Tollett, et al. Plaintiffs suing Henninger for $2557.60-the amount reported to the last term of Chancery Court to have been in hands of defendant in said cause. Henninger in similar case but against W. A. Green, admr. Of John Walker, dec., et al. found in box ET 1212

Elizabeth Jones, formerly Crawford died. This suit began in 1857, & at the time S. C. Norwood, clerk, had money from the Jones estate for her heirs, that he instead lent to people. When the borrowers failed to repay the sum, the sheriff levied a tract of land belonging to them, then sold it. Suit seeks to recover their inheritance, settling a long chain of debt & borrowing.

Complainant charges that defendants sold five hundred acres to him and that the legal title of the land should be vested in him.

Plaintiffs: Jacob W. Horter, John Horter, Hiram Horter, & Lafayette Horter-all of PA; Defendants: A. B. Billingsley, Jesse Lawson, R. R. Ward, Richard Blalock, P. S. Hutcheson, S. C. Norwood, Jane Knight-all of Bledsoe Co., John Teese & wife, Mary Magdalene Teese, Jonathan Stackhouse- all non-residents (from PA?). 5,000 acre tract near Glade Creek, acknowledgment of deeds; ejectment threatened.

Additional Complainant: Nancy Roberson Nelson, admr. of Mills Roberson, dec. Additional Defendants: Willis Hunter, Minerva Roberson Hunter. Exhibits: depositions.

Add. Def: William C. Dixon [Dixson?] (of Missouri). Jubal owned 272-1/2 acres in Marion County on the Sequatchie River, 172 acres of which was "pretended to be sold" at a trust sale years ago, but was then redeemed, such "pretended" sale being related to a debt belonging to Jubal's son Def. William. Jubal says Knox lived in the neighborhood & knew the debt was William's & the land was redeemed for Jubal, & claims William & Knox have colluded to defraud Jubal.

Debt involves a tract of land.

Robert Worthington was indebted to John K. Browne & others. His land was seized by the county & sold by the sheriff. Brown bought the land, w/ the aim of selling it back. Worthington died intestate, Brown offered to sell to the heirs as a group. Both Columbus & Samuel began timbering the property without permission of the other heirs. The other heirs sued to make the stop timbering & to approach their land ownership as a group in agreement.

McBray, Mary McBray, Robin Boyer, Matilda Boyer, Thomas Jones, Matilda Jones, Mary Jones, John Jones, Charles Jones, W.H. King, Wm. Corberry adm. Of John Crawford dec. Additional Plaintiff Martha Schoolfield. Case was over land and who had the right to the title and to sell the land.

Case file is incomplete; brief only. See ET 1990 for more of case. Swafford owned a tract of land in Bledsoe Co. Hamilton claimed he had interest in a portion of the tract & was cutting timber on that portion. Swafford was seeking confirmation of his ownership of entire tract.

Over 20 defendants listed as heirs of David F. Cocke, owner of a huge parcel of land: David W. Walker, B. F. Loyd, F. M. Clark, Alfred Warren, Lewis Boyseton, Thomas Blalock, W.B. & Lafayette Smith, R.B. Worthington, John Edmund, Owen Rector, J. N. Watkins, Asa Blaylock, S. H. & Joseph Myers, Parrick Norris, Abraham Norris, John Vantress, R. H. Braun, C. C. Duncan, John & William Nanney. The land was surveyed incorrectly & pl's seek to collect back land taxes from rightful owners.

Additional Defendants: Ruth Hoge (wife of Guy Hoge); J.F. Hoge, admr. of J.R. Hoge, dec. J.R. Hoge was Rhoda's husband, and J.R. died 1 week before Rhoda died. Estate administrator sued to collect on two notes, roughly $1500 each, one owned by Rhoda & one owned by J.R., both of which were secured by a farm owned by defendants.

The assets of Aaron Swafford, dec. are insufficient to pay debts and liabilities of the estate. He was also indebted to various other firms and individuals. Rankin and Alfred Swafford charge that defendants have no right to three slaves (Rachael, Lizzie, and Andrew), and that they be sold with the proceeds going toward the payment of debts. They also wanted any remaining assets after debt was paid to be distributed among the creditors. There are many defendants in this case.

Plaintiffs are the administrators of the estate of Alexander A. Montgomery (dec.). Plaintiffs claim the defendant was indebted to the deceased for labor done on a project.
