2 cases (Railroad Co. v. Tracy, admr. Of Ernest L. Tracey, dec.; Railroad Co. v. Burgin, admr. Of John Burgin, dec.). Tracy and Burgin separately sued the railroad co. for $30,000 each in damages for the deaths of John Burgin and Ernest Tracy, both of whom were riding in car with W.B. Cannon, who negligently drove in front of train. Pla. charged that deceased were not at fault and that their deaths were the result of the joint negligence of Cannon and railroad co. 4 folders. Add. Frank Gillespie, Aaron Myers, and Ed Gillespie were driving under the influence at night, without headlights on, when they ran into and over Robert Anthony, killing him. Myers was found not guilty but Gillespie was convicted and sentenced to 3 years in penitentiary. 2 folders. |

William Ballew, Jr. also listed as defendant. In 1930, the defendant feloniously and willfully hired and aided W. Ballew, Jr. to set fire to and burn down his house. Def. is the owner and operator of a small grist (corn mill) located in the 7th Civil District of Blount County. Said mill is powered by a Fordson Tractor. Pla. claims he was instructed by the Def. to crank the tractor in order to place the motor in operation. When Pla. attempted to turn the crank, the tractor threw the crank and severely injured the Pla. Pla. states that the Def. did not warn him of potential dangers. |
