Dr. Taylor says Hooper took & converted to his own use a 1-yr old bay colt with a blaze in his face & 1 white foot. Justice of the peace awarded Taylor $45; appealed to Circuit. Witnesses: Hooper came to Taylor's house w/M.G. Sprinkle, Hugh Bogle & Samuel McAnnally & took colt out of Taylor's lot. Hooper's defense was that the ordinary constable had gone to the South w/horses & in his absence, Hooper was deputized & in that capacity levied on the horse to satisfy judgments Sprinkle had against Taylor. |
