This is a matter of a lost note for payment of debt and the decision concerns which party carries the burden of proof.

Plaintiff claimed that the defendant still owed for previous debt that was created by the defendants father, James Murphy, deceased at time of the this lawsuit. Total amount of debt is not listed. Plaintiff Stephens also claimed that James Murphy had fraudulently conveyed property to Tim and Emily Murphy to avoid paying his debts.

West was accused of swearing in public and taking god's name in vain. He was quoted as saying, "G*d d*mn you, you all are g*d d*amn liars" and other profane oaths.

Fuggitt was accused of making noise, profane discourse, and rude and indecent behavior.

Horace Knight and Sarah Goins charged with theft of 300 rails worth $90. Grand jury indicted them only for trespass. At trial, Sarah Goins could not be found. Knight moved to quash the indictment for trespass and State appealed to TN Supreme Court.

Phillips was charged with disturbing Ausments Chapel Church in Cannon County with noise, profane discourse, rude and indecent behavior.

This relates to the estate of Stephen Mitchell (d. 1853). He had an entry for land in Warren County (now Cannon) of 100 acres and he told his son Stephen A. he would have this land. The land joined other land owned by Stephen Mitchell and he sold a tract of 459 acres which included this 100 acres which Stephen A Mitchell believed he owned. Other children are noted by byname.

The defendant was charged with "abduction and seduction" of a woman named Elizabeth Woods for the purpose of prostitution.

The defendant was charged with openly frequenting a bawdy house to the common nuisance of public morals.

In 1874 Elkins "did profanely curse and swear and take the name of g*d d*amn in vain openly, publicly, and notoriously, and in a public place and in the presence and hearing of divine good citizens of our said state."
