Nance Motor Co. repossessed Tipton's Plymouth because of delinquent payment. Gump held the note. Unbeknown to Tipton, his son, Will Tipton, bought the car on the same day it was repossessed. Will wrecked the car & Nance picked it up for repair. When Nance attempted to return the car to Will, he would not take it. Nance then went to defendant to induce him to take the car. He would not. In 1928, the parties entered a contract where the plaintiff agreed to buy lots and build 12 houses on them, ready for occupancy a few months later. The defendant agreed to be liable for the rent for the first ten years, at $393.10 per month. After the first month, the defendant refused to pay the plaintiff, instead collecting rent from the houses but not forwarding the money, even though the plaintiff accepted a loss of $10,000 due to the contractual estimate for construction. |

Cordell sued Wright for $499 for breach of contract and Wright made a counterclaim against Cardell for $297.74, the amount overpaid to Cordell on the contract. Cordell was contracted to cut and deliver lumber to the TN, Coal, Iron & Railroad Co. at Shell Creek for $19 per thousand feet of lumber. Court ruled in plaintiff's favor for $463.39 damages for his failure to pay. Wright appealed. Exhibits include receipts showing different lengths and amounts of lumber and checks to Cordell. 2 folders. |

Original bill was filed when a breach of contract by N. A. Lackey occurred in 1927. The defendants bound themselves in a contract to furnish the plaintiffs' with $5,000 worth of building material and lumber and to use their best efforts to obtain a loan on their property if they didn't have the funds to pay the defendants when building was complete. The plaintiffs later failed to carry out their terms of the contract by paying 15% of the material not used, or $750. |

Case seeks to settle ownership of land and settle debt to Peoples. |
