Adair gave Davis a note for $30 in 1841. Davis had inherited 1/4 of a tract of land in Cocke County, & Adair purchased the land from Davis via note. It was later discovered that William Davis'will, father of Thomas, bequeathed all of the land to other heirs, leaving Thomas with no land. |

The plaintiff owned property in 1868 and 1869 and made taxes payable by the clerk of the county court and were collected by J. Rem, who was at the time the revenue/tax collector for the county. The constable, James Arrington, then said the plaintiff was liable for the said taxes he had already paid to the county. |
