This suit was originally brought by the defendant in error against the plaintiff in error to recover debt due from the purchase of furniture on an installment plan. When he became unable to pay, the plaintiff notified the defendant who then repossessed and sold said furniture. There is a questions as to whether or not the plaintiff waived his right to have the furniture sold at public auction as provided by law. |

Defendant charged with "trespass in the case of assumpsit". Plaintiff sued defendant for $500 damages, charging that he has refused to repay $120. The problem arose from a horse race between Swagerty & Stokely that occurred in late July 1850 in which each man put up a $100 stake. |

Incomplete casefile. John D. Smith was the executor of John Maloy dec'd. The plaintiff received a prior judgment against the defendants. The defendants were forced to sell land in order to settle the debt awarded to the plaintiff. Plaintiff purchased the land using credit from the judgment awarded to him. Ownership of the land was then questioned. See additional documents in box ET 6, ET 788. |

Witnesses: S.D.M. [or S.M.D.] Thomas, who clerked for Plaintiffs; Thomas S. Gorman. Dispute over whether Def. James was liable for the debt, or just Irvin (Irvin also spelled Ervin), as James' name was not on the note evidencing the debt. |

Hill's, burial expenses. He absorbed unnecessary expenses and inconveniences. He was later judged against for the sum of $260. Includes motion for a rehearing, new trial, and petition for certiorari. |
