Defendant was negotiating a sale of the mill and timber to Haslett & Co, but later sold it to the plain- tiffs under their firm. The defendant failed to inform them during negotiation that per an original contract, one T. Ashby held a lien on the mill and the defendant actually had no legal title to it, despite the plaintiffs paying a $720 note to Haslett. |

J. L. Dibrell of White County died May 1910 leaving a will which appointed Meredith as admr. cum testamento anexo and qualified as such admr. and entered upon the discharge of the duties of trust. Dibrell in his lifetime borrowed for defendant $6700 & executed 2 notes. Only security taken was stock in Bon Air Coal & Iron Co. This stock and equal amount of said notes were sold and applied to the credit. However, Dibrell's estate insolvent and the defendant lost the majority of these notes. |

In 1843 land belongong to Thomas Patton, then deceased, was sold to an ancestor of Stephens. Martin the obtained a decree in chancery court against Patton's estate, for $370 which was declared a lien on the land that had been purchased by Martin.
