Fowlkes originally sued the railroad for $60, the value of his cow that was struck & killed by a train belonging to the company on 4 Sept. 1904. Defendant argues that it is not liable as the cow was killed on the public road crossing. Fowlkes maintains cow was killed south of the public road crossing on a railroad right of way that should have been fenced. Also argues engineer was negligent as he made no effort to avoid hitting the cow although he saw her in time to take action. |
