In 1860 B. W. Mason recovered a judgement against D. G. Usery & F. P. McMillion for $150 and costs. Then he recovered other judgements of various amounts from the same defendants. The defendants were found to be completely insolvent and the judgement was transferred to Elisha R. Davis. The plaintiffs asked that the land belonging to McMillion be attached to the debt and sold to satisfy it. |

Dennis believed he was entitled to the land. Testimony of G. W. McGrew references the burning of the fence that enclosed the land in dispute by Gen. Hood's army during 1864. |
