Allsup purchased a note originally executed by Smith and payable to J. Coffey. Allsup asked Smith to secure the note. Smith did so by placing into Allsup's hands several other notes as security. Smith now claims that his original note to Coffey is paid but Allsup has since refused to give back the notes held in security.
