Case by same name in ET 99, but has a different county. Add. defendant: S. A. Brooks. In 1865, the plaintiff purchased from L. N. Homer a tract of land for which he was executed a bond. The property is very valuable for the water power and sought to build a grist mill and brought in the defendant to help fund it as security and advancing him $2,000. The plaintiff executed to him a deed of trust, but the defendant has failed to keep up his end of the negotiated contract. |

Allsup purchased a note originally executed by Smith and payable to J. Coffey. Allsup asked Smith to secure the note. Smith did so by placing into Allsup's hands several other notes as security. Smith now claims that his original note to Coffey is paid but Allsup has since refused to give back the notes held in security. |
