Plaintiff, daughter of def.. & his wife, Palestine Popejoy. By agreement plaintiff & her mother were named the beneficiaries of a $1700 life insurance policy purchased by N. Popejoy in 1924; they also paid the premiums. Mrs. Popejoy died May 1929. Plaintiff continued to pay premiums after mother's death, but has since learned that ca. 24 Nov. 1934 the deft. made an Ann Johnson the beneficiary instead of herself. Plaintiff now suing to recover the money spent on the insurance premiums. |
