Thornburgh executed $100 note in favor of Harris, who gave Confederate money (rebel money) for the note, which Thornburgh used to pay another debt & to pay a high price for medicine. Dispute over whether Confederate money qualified as consideration. Thornburgh argued no consideration for note, since Confederate money not recognized by law as money at all & had no legal value. |

Circuit Court entered numerous judgments in favor of Pla. & against Def Rail Road (enumerated in transcript), all upon which execution issued but returned unsatisfied. However, Rail Road's stockholders were indebted to Rail Road to extent of unpaid stock subscription, so Pla. filed suit to ask Chancery Court to satisfy their judgments out of said debt of said stockholders (names & amounts enumerated in transcript). |

Atkinson was married to Rhea's daughter Elizabeth. Nancy's mother was Dinah, who originally belonged to Rhea. Case mentions the Atkinson children: Pharoe, Joseph, Catherine, & James. Joseph Cobb was Atkinson's security. |

Add. defendants: Columbus Justice & Robert Justice. In 1866, the plaintiff was the owner of a large tract of land that was later conveyed to the defendant for the consideration of $2,500. The defendant executed a bond for $1,500, which was the balance of the purchase money after an initial payment. The defendant failed to completely pay the balance and the plaintiff now believes he will fraudulently dispose of certain property and funds to avoid judgment for the balance. |

Dispute between estate of Montgomery Bell & estate of Jenkins Whiteside (& estate of brother Thomas who, while living, was executor for Jenkins' estate). Jenkins managed Bell's business affairs and, according to Bell, served as his "solicitor, confidant, agent & counsellor." Affairs between Bell & Jenkins went unsettled for awhile; then Jenkins died, owing Bell money. Bell sued & recovered judgment but no property to satisfy. Yrs later, this suit filed to try again to satisfy judgment. 2 folders. |
