Judgment rendered against Jones in favor of Williams, who then satisfied that judgment by levying on a parcel of corn (14 barrels) belonging to Jones, which corn Jones believed to be exempt from execution because Jones was a head of family.

Plaintiff in error had a judgment rendered against him in a previous case. Judgment was awarded to defendant, this case was filed in an effort to reverse judgment which was for $50.00.

View Entry David Evans v. Allen Hurst, et al Grainger Debt

Evans sued to have the court prevent the sale of his land for debt; he also asks the court to ascertain how much he does owe Hurst as he believes that some of the debts with which he has been charged are fraudulent. Evans death suggested September 1847.

Dispute re: prior suit by Lambden against Isaac B. Butcher (and Peter Sharp & Co. as security) over 2 notes owed by Isaac, who then died, after which Lambden revived suit against Haston, believing he had bound himself as security for debt, which he denied Case related to 2 other cases, one found in ET Box 1158 (Peter Sharp & Co. et al. v. John Lambden) & the other found in ET Box 1121 (John Lambden v. John Sharp & Allen Hurst).

Additional defendants: Daniel Carmichael & Henry Mayse, admr. of James Mayse, dec. Plaintiff brought suit to collect $150 debt and damages of $100. Jan 1840, defendants had entered into loan agreement with plaintiff, and eventually paid $193.29.

Thornburgh executed $100 note in favor of Harris, who gave Confederate money (rebel money) for the note, which Thornburgh used to pay another debt & to pay a high price for medicine. Dispute over whether Confederate money qualified as consideration. Thornburgh argued no consideration for note, since Confederate money not recognized by law as money at all & had no legal value.

Defendants contracted with the plaintiff for the purchase and delivery of 335 crossties. Plaintiff delivered said crossties but defendants denied entering a contract and refused to pay. Plaintiff brought suit to collect debt.

Rhea recovered judgment against Atkinson for debt & filed suit to execute that judgment against Atkinson's property, specifically a negro girl aged 9 or 10 named Nancy, but her ownership was in dispute. Atkinson was married to Rhea's daughter Elizabeth. Nancy's mother was Dinah, who originally belonged to Rhea. Case mentions the Atkinson children: Pharoe, Joseph, Catherine, & James. Joseph Cobb was Atkinson's security.

View Entry 1855 The President & Directors of the Bank of Tennessee v. James A. Waggoner, Thomas Waggoner & John Cox Grainger Debt

Bank sued defs for $1200 debt. (At some point, James dropped from the suit.) Debt related to underlying bill of exchange drawn on Bank of Harrisburg in Harrisburg, SC, which bill was presented for payment but not paid. Jury found defs owed the bank $800 (not $1200).Possibly related to debt case: John Cox v. James A. Waggoner & Thomas Waggoner in box ET 1159.

Plaintiff claimed he had paid $1.20 towards notes he owed to the defendant but the defendant had not credited the payment. Case was filed as a debt case.

Brooks left home for the Army is 1862. Before leaving he loaned Lean, the plaintiff in error, $1,000 in Confederate money for the purchase of a mill. Brooks claims Lean has never repaid the loan.

Plaintiff in error was sued by Hayworth and Son for debt due on a note given for the purchase of produce. The original case included A. S. Sellars as a co-defendant. There is a question in this case as to whether or not Sellars can legally be regarded as a business partner to Boond and if Sellars had the legal right to sign their partnership name to a note.
