A bowling alley was sold, warranted and a note given in payment. The bowling alley was defective and unfit for use. The plaintiff refused to pay the note and tendered the bowling alley back to the defendant. The plaintiff claims that defendant breached the warranty.

Complainant is sued for breach of contract. The complainant was to have rights within certain regions of Kentucky and Tennessee to sell miniature golf courses. The defendants sold such courses within the contractual areas without complainant's knowledge and without paying him a commission. Plaintiff sued for $9000 in lost commission. 4 folders

On 17 Oct. 1929 plntff. Purchased Lots 5 & 6 from the deft. For the sum of $2250 to be paid in installments. At the time of the transaction plntff. was led to believe the property was "free & unencumbered", with no other mortgages or liens. He has since learned the deft. mortgaged the premises to Hamilton Trust & Savings Bank to secure a $1000 indebtedness. Plntff. is now suing for breach of contract to recover monies already paid & monies spent on improvements that he made to the property.

Thompson bought truck from Def. Newton-Chevrolet in Chattanooga, trading in his old truck for partial credit against purchase price of new truck, with balance to be paid in installments, but when Thompson defaulted on 2 pymts, Defendants took truck back. Thompson sued, alleging Defendants failed to comply with conditional sales law & converted truck to their own use when they resold it after repossessing it. Thompson was partners with Fred Dicus, negro, in the transfer business.

View Entry 1932 Montgomery-Ward & Co. v. Raymond J. Bork Hamilton Breach of Bond

Bork is sued Montgomery-Ward & Co. for damages for a breach of contract. Montgomery-Ward entered into an oral contract through their agent promising to install a hot air furnace in Bork's house. Montgomery-Ward failed to comply with the contract by start on time and then failed to install a wall stack in one of the rooms as promised. Exhibits include a failure to perform contract.
