Martin drew note payable to Rogersville Branch of Bank of Tennessee, Galbraith as 1st endorser & Findley as 2nd endorser. Martin insolvent. Dispute over who was beneficiary of the note. Witnesses: James Bradley, John Mallory, John Pilant, Michael Baugh. Findley sued Galbraith in Circuit Court, claiming Findley paid the note & Galbraith as 1st endorser must repay Findley as 2nd endorser. Galbraith has defense available only at equity so sued in Chancery to assert that defense & enjoin Circuit suit. |

Judith- Smith's wife and daughter of deceased, leased out the plantation for income, yet has also been charged with letting the property fall into disrepair. |

Gave broad powers to widow Matilda & father-in-law Nall, exes., to distribute his large estate. Plaintiffs are Thomas Sr.'s minor children who say Nall mismanaged estate & converted property to his own use, & say dec. left broad powers to exes. so Matilda & children could return to East TN as soon as possible to avoid the disease. |

Plaintiffs: Robert Kincaid, Stockley D. Mitchell, Willie B. Mitchell, & James M. Heard. Defendants: Benjamin Tingly & Marshall Hill. Netherland & Kincaid were executed a deed for a tract of land for the purpose of securing debts from executor Clinton Armstrong. Defendants, working as a firm, obtained a judgment against Armstrong for $700 to levy the land executed to plaintiffs for the sum owed unlawfully. Trying to obtain injunction to stay execution of the land. |

In 1782 North Carolina granted Lowery said tracts of land. Lowery sold and conveyed the land to Campbill. Campbill sold the land to Hopkins. Hopkins sold to defendant. Plaintiff and defendant have a boundary and title dispute over the property. Historical Note: land granted prior to TN becoming a state. |

Murphy agreed to convey 40 acres on Stacey's Branch to Tallent, as soon as Murphy could get a grant from the state (because his claim to the land was an entry). And Tallent would convey to Murphy 50 acres (Bill Johnson tract). 40 acres not conveyed. Instead, Murphy sold it to Joseph McCall & moved to Missouri. Testimony: claims of intoxication, bribery, that Tallent lived with Avis Williams who wasn't his wife, that Murphy moved due to son's conduct, that witness Polly Smith was mentally deranged. |
