The plaintiffs owned a tract of land that they deeded to the defendant in exchange for another tract of land per a written agreement. However, Hickman Kile's son wrote the deed for the tracts of land to Archibald, which contained 15 to 20 acres more than the agreement stated. The plaintiffs did not realize the discrepancy until after they registered the deed. The plaintiffs sought correction of the deed in accordance with the original agreement. |

Bautz and Edward S. Bourne. In 1862 Clisbe Austin purchased of C. J. McKinney 80-100 acres of prime land. Purchase was made in Confederate money. John A. McKinney sued for the recovery of the land, saying that his brother never had title. |

Plaintiff in error is described as ignorant, uneducated, and having spent time in a penitentiary. Plaintiff in error initially admitted to the burglary but, according to police, was under the influence of alcohol. When he became sober again, plaintiff in error denied the crime. |

This case was consolidated with Nancy Dalzell, John Shanks, admr., Margaret Kayter, J. A . McKinney, admr., C. C. Miller, Wiley Miller, Wesley Phipps, all v. George Powell. Stated in Decree on page 319. In May 1868, Alexander purchased land supposedly previously belonging to Powell. Deed said that any debts called on Powell in the next two years could be paid by possession of the land purchased by Alexander. Case seeks to settle debts and disputes on land ownership. |

Add Defs: Lula Catron, Dock Catron, Burket Catron, and William Catron. George Catron and his wife Elizabeth conveyed a tract of land to Gonce for $1400 and issued him a title bond. Gonce paid $500 and 2 horses up front and executed a note for $675, which he paid. Gonce claimed that Elizabeth put the funds to her own use and later died. Gonce claimed his right to ification of the contract and return of payment. |

File incomplete. Brief only. In 1878 Davis & his wife sued I. W. Campbell for the balance of $500 due them as payment for land in Sneedville that they sold to Campbell and F. S. Bray in 1875. Campbell countersued, charging Davis with fraud & alleging that Davis had no title to a portion of the land within the boundaries described by the deed. Bray had conveyed his undivided share of the land to Campbell in consideration of Campbell's paying the Davises. |

The plaintiffs disputed the boundaries that were included in the deed and claimed that there was a piece of land that was omitted by the mistake of defendant S. D. Brooks. The plaintiff sued the defendants to reclaim 42.5 acres of land he claimed to have a grant for from the state through Governor Robert L. Taylor. He charged the defendants with illegally possessing said land and striping it of its valuable timber. Claymon requested an injunction to halt the removal of resources from the land and requested a survey of the land and confirmation of its ownership. Includes hand-drawn map of disputed land. |

(Oct. 1819, 131 acres sold for $780, to be paid in 5 annual installments of $156) Upon default, James Thompson filed suit and sought to force sale of land to collect. |

Over the course of several years the Rowan family engaged in litigation with John D. Riley over possession of a certain tract of land known as the "Beech Creek Bottom." The related case, "Myra M. Orr v. Joseph Orr, et al." may be found in ET 43. While the parties are primarily the same, it appears that these are two separate suits. Pla. and def. were granted a divorce in 1926 and entered into a contract setting forth their mutual property rights. Said contract included a guarantee that the def. would carry a $10,000 life insurance policy and name the pla. as his beneficiary. Pla. claims the def. has failed to honor this agreement. |

McCarty, dec.'s land, which was fraudulently taken by Robert Kyle. |

Before Wm died, he gifted Rachel & her 5 children 3 tracts of land aka the old Egypt place, on south bank of Holston River, in such gift deed consolidating all 3 tracts into 1 tract comprising 345 acres & providing for division of tract into 6 undivided shares, 3 of which Lyons came to buy. This dispute followed. |
