Firm of Benjamin & Wilkins comprised of Cleon Benjamin & C. F. Wilkins. Deft. petitioned the court to overturn a judgment of $34.87 plus court costs against him & in favor of plntffs. In 1885 plntffs. contracted to saw lumber for deft. at a cost of $3.50 per 1000 feet. Deft. paid plntffs. before lumber was measured, acting on their estimates, but found he had overpaid them when lumber was measured. For this reason deft. argued plntffs. owed him the amount they had been overpaid & he owed them nothing. |
