Martin drew note payable to Rogersville Branch of Bank of Tennessee, Galbraith as 1st endorser & Findley as 2nd endorser. Martin insolvent. Dispute over who was beneficiary of the note. Witnesses: James Bradley, John Mallory, John Pilant, Michael Baugh. Findley sued Galbraith in Circuit Court, claiming Findley paid the note & Galbraith as 1st endorser must repay Findley as 2nd endorser. Galbraith has defense available only at equity so sued in Chancery to assert that defense & enjoin Circuit suit. |

Miller alleged that Watkins was indebted to him as admr. and argued that Watkins' land (which Miller argued had been fraudulently conveyed to the the other defendants, Watkins' children) be sold to pay Watkins' debt to Miller as admr. Samuel Bunch got judgment against brother-in-law Thomas M. Anderson in Circuit Court for note Thomas endorsed as accommodation maker for brother John H. Anderson (went bankrupt & moved to Mississippi) & Bunch. Later transactions involved Samuel's son McDonough Joseph Bunch. Samuel died; admr sued. Thomas says Samuel promised to pay 1/2 original note, but didn't; asking court for relief. Testimony: Samuel "addicted to habits of intemperance" in yrs before his death. Thomas died while suit ongoing. |
