Plaintiff Henry Watkins, "colored," petitioned the court for an injunction to prevent the defendants from disallowing the plaintiff from using their private road to reach the public road. Watkins bought the land from a relative of the Kirkpatricks who was allowed right-of-way since they inherited the land. However, when Watkins bought it he was forced to gain access to his land through the brother of C. M. Kirkpatrick, who then also denied him access. Defendant is business partnership between Jacob Mayer, Levi Strouse, & Joseph Baum in Philadelphia, Penn. They won judgment against L. E. Fernandez but Pace (Hawkins County justice of peace) refused to issue execution on judgment. |

A William M. Ford purchased horse from Looney to go into Confederate cavalry. Ford issued note with Gilliam and others as sureties. Later, warrant issued upon note by Looney. No other notice given on the matter. Judgment and execution were rendered against Gilliam without his knowledge of any proceedings nor could he made an appeal from judgment. Gilliam applied for writ of certiorari. |

Plaintiff shows that he purchased a safe from the defendant for $10, but a short time later, a William Giggsly came to the plaintiff's house and took it, stating it was his property and never belonged to the defendant, who refused to refund the money. Judgment was rendered against the plaintiff in favor of the defendant for costs of court. The plaintiff states he would have appealed and consulted his lawyers, but was told the time frame had elapsed. |
