Buckeye Marble (a foreign corporation) contracted with the defendant for the purchase of the whole and entire stock of the McMillan Marble Company (a Tennessee firm). Buckeye wanted the contract enforced. Harvey argued that Buckeye was taking advantage. "Can a foreign corporation come [into Tennessee] and swallow up one after another" the 10,010 domestic corporations for "such a nefarious and infamous intent and purpose?" Referred to is a suit against Buckeye in the death of William Shrum. |

Cooper was executrix of her late husband Thomas Cooper's will. He died in 1885 and left his entire estate to his widow. Mary May purchased Eliza's home in 1886 and occupied it. Eliza had left in the cellar--with May's permission--considerable personal property which she was to retrieve later. Thomas was very distrustful of banks and habitually kept money (including 31 gold coins) hidden in the house. One of May's children found the coins, so Eliza asked its return. Unfortunately, May spent it. |

Houston and dfnt. agreed on deed payment of $500. After dfnt. failed to make payment, he again tried to secure another deed for the same property from pltf. However, this time he claimed a large lien was placed on pltf. and property, and by giving him the deed to the land, said lien would be settled and removed, pltf. discovered this was a lie and sued to reclaim her right to said to property and have deed declared and void. |

Burnett acquired a draft for $545 from American Drying and Seasoning Company to A. J. Proffitt at the Bank of Asheville (Asheville, N.C.). Proffitt signed the draft over to Burnett. Burnett deposited the draft w/ City National Bank. Bank was supposed to collect the money from Bank of Asheville when it came due, but City National Bank lost the draft & never collected the money. |

The defendant took a lease of five years out in his name and took possession of said building and made internal changes. The complainant claimed that Jarvis committed fraud by taking out a lease in his own name and to appropriate out $1,000 dollars without mentioning the fact to any other officer or any other stockholder of the complainant. |
