The def was a benefit fund insurance company & had issued Whiteside's husband a fund of $2k payable to her upon his death. Her husband died with all premiums & dues up to date. They refused to pay stating that Charles Whiteside was in poor health when he signed the paperwork. Whiteside sued to recover the benefit due her from claim.
