Willis approached plaintiff for purpose of selling a truck and agreed to sell their old Mack truck for $600. C.D. Willis was accidentally killed before he could fulfill the agreement; therefore, his estate became liable. Plaintiff suing defendant to comply with agreement and pay them $600 due them under the terms of said agreement. Exhibits include 4 pictures of truck and notes made out to Mack Trucks. |

Brooks believes the defendant broke into his desk and destroyed his copy of the agreement before trying to dissolve the partnership and also took money made by the firm, part of which rightfully belongs to the plaintiff. |
