Porter to Thompson Wright. No deed was found and no recording of the deed was found. Defendants sold the land to Jacob Eller in 1867, and claimed title through adverse possession. Plaintiffs claimed no land sale because Mrs. Porter's mother, Mrs. M. J. Lakes Uhles, was a minor and could not consent to it. |

The contract stipulated the mill would cut & process timber, allow Siddens to claim his stake, then use any remaining for sale. Scire facias was filed because one or more of the defendants had died. In 1858 James D. Bennett purchased three mules and a colt from Taylor in exchange for $230. No money was given at the time of purchase, Bennett held two promissory notes on Isaac A Livingston. However, Taylor failed to collect the money on the notes from Livingston, so Bennett was still indebted to Taylor. Taylor sued to finally collect the debt. |

Plaintiff then received a judgment against the defendant and ultimately purchased the property back at a county auction held to satisfy said judgement. Defendant claims a homestead exemption. |
