In 1883, D. G. Cooper executed a promissory note to F. H. Watkins for $300.00, secured by a mortgage on some land. Initially, Watkins refused to make the loan. When he did finally agree a few months after, he only gave him $80.00 and was to pay off certain judgments against the plaintiff in the circuit court. After Watkins had asked Cooper several times to renew the mortgage for more money, Cooper began to suspect that something was amiss. |

She is looking to recover money due her for additional lessons. |

Plaintiff was driving a wagon along said street, when a train passed. Plaintiff claims that said train failed to blow the whistle or warn the public of passing, hence negligence. Said train passed 3 feet in front of his wagon, scaring his horse, causing plaintiff to be thrown, break his leg, and lose work. |
