Harris & his wife sued railroad to recover damages for injury to land (which bordered Fountain Creek, over which ran a railroad bridge) from the deposit of slag, coke & other deleterious substances washed from an embankment railroad built, a portion of which was created using refuse of coke ovens from Tracy City, TN. Opinion references extraordinary flood in this creek in March 1902. Mr. Hicks was railroad engineer. Circuit court ruled in Harrises' favor; railroad appealed; SC reversed. |
