In 1883, D. G. Cooper executed a promissory note to F. H. Watkins for $300.00, secured by a mortgage on some land. Initially, Watkins refused to make the loan. When he did finally agree a few months after, he only gave him $80.00 and was to pay off certain judgments against the plaintiff in the circuit court. After Watkins had asked Cooper several times to renew the mortgage for more money, Cooper began to suspect that something was amiss.

The pltfs sold to dfnts Bond a certain lot of land in in Maury County the total amount due 12 months after the death of dfnt. Payments were to be made annually until the death of dfnt on Nov. 15, payments were missed. Pltf sued for payment and interest on said note.

John M. Larkins and John A. Walker merchants in Columbia, TN. W. J. Dale appointed trustee of J. M. Larkins and Co. A note conveyed to Dale by defendant L. Hoge for $582.97. Mrs. Hoge promised to pay the note with 10% interest per year until paid in full. The firm failed and Dale, as trustee, filed the note against L. Hoge and her husband and subjected the separate estate of the wife to its payment.
