In 1883, D. G. Cooper executed a promissory note to F. H. Watkins for $300.00, secured by a mortgage on some land. Initially, Watkins refused to make the loan. When he did finally agree a few months after, he only gave him $80.00 and was to pay off certain judgments against the plaintiff in the circuit court. After Watkins had asked Cooper several times to renew the mortgage for more money, Cooper began to suspect that something was amiss. |
