Prior to October, 1891, complainant was the owner of a note for $185.00 made by B. H. McKennon which was over due. The note was given to Hughes & Hatcher for collection. They placed the note with J. C. McGaw, a constable of the County who collected the money due - $208.85. When the money was collected, it was deposited in a bank that was failing. |
