2 Folders. The Vice President of the First National Bank, Grover Cleveland Adams, lacking the authority, made loans totaling $7,200 to his brother in law B.B. Fite, without notifying the Bank President or Board. Loan written to finance the Fite Construction Company. To recover the money, the Bank sued the Indemnity Company, asserting that the loan was invalid. Royal Indemnity denied liability and insisted the loan was in fact valid. Exhibits include copies of loans & bills. See also ET 1545. |

The plaintiffs were in possession of a tract of land and were mining for lead and other materials. The defendant, with help from others not listed, unlawfully and with force of arms entered their property and pulled down the plaintiffs' furnace buildings and machinery, taking some and destroying others. Plaintiffs are suing for damages in the sum of $15,000. |

File contains three briefs from this case first tried in Monroe County, East Tennessee. Other defendant is Zachary Taylor, part owner of Taylor Bros., a foundry. Plaintiff had invented a type of press and contracted with the Taylors to construct it so it could be displayed at the Rhea County Fair. He says the press they constructed was of inferior quality, as was a second attempt. Additonal pages found in box ET 1690 and in 2 folders. |

Minton (who is "illiterate & cannot read writing") bought land from Charles for $1,500 ($500 down & 2 $500 notes), & Charles executed title bond for land. Then Charles died & Minton discovered Reuben Faulkner (owner before Charles) had mortgage on land. Mortgage doc purported to be absolute deed but intended as mortgage. Minton informed John (executor) who said he would make sure Minton would have good title, but didn't do so & instead sued Minton on the notes. Minton sought equitable relief in Chancery. |

Morgan had filed his bill against Milligan in 1847 in order to divest the title of a tract of land out of Milligan and vest it in himself. Claiming to be judgment credior to Milligan, Morgan had obtained a decree against Milligan in Chancery court for $336 in 1834. A reference to case Joseph Milligan v. Gideon Morgan in ET 676. Rogers obtained decree in 1857 against Milligan, which Milligan wants set aside. He also wants an injunction to stay issuance of writ of possession from other court. |

Jacob Baker died intestate, his land then partitioned by the heirs, & H. Stephens, Martha's husband, appointed agent to sell the land. It was sold to Mr. Cleburne, who then sold to W. Porter. This suit sought to ify these sales of the land, & return it to the heirs. Martha was placed in an asylum, making her husband the heir to the land. However, the paperwork filed with the court initially left out Martha's incompetency, & therefore were faulty in naming the appropriate heirs. |

Jacob Baker died owning land on little Tennessee River known as Island Farm, leaving widow Ann Baker & 6 children including Louisa, who was previously married (when she was 14) to Daniel Shrader of Virginia & after divorcing him, married Mordecai. Soon after Jacob's death, Howard Henry (who married Louisa's sister) bought the Farm. Bentons sued asking that Henry (now dec) be enjoined from paying (& Stephens' estate from receiving) purchase price for the 1/7 of the farm claimed by the Bentons. |

Wright & Polly (aka Mary) Harvey (mom/guardian of Thos, Chas, Wm, Daniel Harvey, minors) to Richard Stephens, then to his wife Nancy, then sold to Jasper Stephens who sold to Moser. Land in dispute was 2 acres in Hiwassee District, on Island Creek, & contained Stephens mill dam & pond. |

Hooper a tract of 200 acres of land for which he paid $400, to be paid one year from date and Hooper executed a bond for the title. In order to build a home and pay debts, the plaintiff allowed the legal title to be made to his brother in law J.A. Stephens, who later had a judgment rendered against him for debts and the land was listed as his property. |

Several original policies included; also a deed of trust to Bowers and wife, Ada Maye. |

Carter in documents). Robert sold his portion & defendants are all the various purchasers of the land. But purchasers were also claiming to own Jane's land as well. |

Morgan were all sureties for G. P. Carmichael. After a judgment against them, Lee's land was old in a decree and Boyd bought it. He filed suit to recover the land and clear the title of any clouds from claims of the defendants. |

Original bill was filed by Fleming, Rhinesmith & Simons against Burgess and wife for partition of a 40,000 acre tract of land in Monroe County that Fleming claimed 25/32th of. Burgess and wife denied the partition right and claimed 11/32th of tract. The plaintiffs amended and refiled the bill to clear the title and reassert their claim to the partition and portion of ownership. The Burgesses filed a cross bill showing their ownership portion and that of other partial owners. |
