The plaintiff Neils claimed that the defendant attempted to obtain a fraudulent title to a portion of their land and asks for settlement of a boundary dispute and relief from trespass.

Add. defendants: Thomas E. Scott, Sarah Ann Cannon (Scott) (widow of Bartley Cannon), J. M. Lanter, Mary J. Lanter (Scott), James E. Roberts, Joseph M. Spradlin (minor), & Samuel P. Hall. Issue over the estate of Joseph Scott (dec.), who left a large amount of land to his widow and heirs. He was married twice, both unions resulting in children, who are now in dispute over certain parcels of land.

Dispute re Hiwassee District land held by school comm'rs; legislature ordered it sold; held by John Lowry as agent of Toqua Will, school comm'rs, then Henderson for Andrew Miller's heirs. Original Defs: Rob't Stapp, Wm F Brown, Jn Beaty, Solomon Aiken. T. Hartley Crawford (Comm'r of Indian Affairs): Andrew Miller was mbr of Cherokee nation. This case relates to his heirs' claim to reservation of land under Cherokee treaties. Also Cherokees: George Hicks, James Chisolen. See related case in ET Box 1164.

Additional defendants: Alexander McGhee, Mathew McGhee and William Neptow. William S. Blair, deceased. Case mentions land deal between the Cherokee Indians and the U.S. in 1819. Land in question was originally called Blairs Ferry and was reserved to an Indian named Cabbin Smith.

View Entry 1845 Johnson Minton v. John Matlock, exe. of Charles Matlock, dec. Monroe Land and Title Dispute

Minton (who is "illiterate & cannot read writing") bought land from Charles for $1,500 ($500 down & 2 $500 notes), & Charles executed title bond for land. Then Charles died & Minton discovered Reuben Faulkner (owner before Charles) had mortgage on land. Mortgage doc purported to be absolute deed but intended as mortgage. Minton informed John (executor) who said he would make sure Minton would have good title, but didn't do so & instead sued Minton on the notes. Minton sought equitable relief in Chancery.

Additional defendants: Daniel Anderson, William Anderson, Malinda Anderson & John McNair. Tract in dispute was a quarter section of land in the Ocoee District. Court found for plaintiff & granted all rights and title to him.

View Entry 1867 Joseph S. Milligan, et al. v. Andrew L. Rogers, admr. Of Gideon Morgan, dec. Monroe Land and Title Dispute

Morgan had filed his bill against Milligan in 1847 in order to divest the title of a tract of land out of Milligan and vest it in himself. Claiming to be judgment credior to Milligan, Morgan had obtained a decree against Milligan in Chancery court for $336 in 1834. A reference to case Joseph Milligan v. Gideon Morgan in ET 676. Rogers obtained decree in 1857 against Milligan, which Milligan wants set aside. He also wants an injunction to stay issuance of writ of possession from other court.

View Entry 1855 Martha E. Stephens, guardian, et al. v. W. W. Porter, et al. Monroe Land and Title Dispute

Jacob Baker died intestate, his land then partitioned by the heirs, & H. Stephens, Martha's husband, appointed agent to sell the land. It was sold to Mr. Cleburne, who then sold to W. Porter. This suit sought to ify these sales of the land, & return it to the heirs. Martha was placed in an asylum, making her husband the heir to the land. However, the paperwork filed with the court initially left out Martha's incompetency, & therefore were faulty in naming the appropriate heirs.

View Entry 1861 Mordecai S. Benton & wife Louisa E. Benton v. Howard Henry & J.M. Fleming, admrs ad litem of H.H. Stephens, dec. Monroe Land and Title Dispute

Jacob Baker died owning land on little Tennessee River known as Island Farm, leaving widow Ann Baker & 6 children including Louisa, who was previously married (when she was 14) to Daniel Shrader of Virginia & after divorcing him, married Mordecai. Soon after Jacob's death, Howard Henry (who married Louisa's sister) bought the Farm. Bentons sued asking that Henry (now dec) be enjoined from paying (& Stephens' estate from receiving) purchase price for the 1/7 of the farm claimed by the Bentons.

View Entry 1860 Noah Moser v. Thomas G. Harvey Monroe Land and Title Dispute

Moser sued Harvey for cutting down & removing timber from Moser's land. Transcript traces chain of title for Moser's land, originating with title bond from Iredell D. Wright & Polly (aka Mary) Harvey (mom/guardian of Thos, Chas, Wm, Daniel Harvey, minors) to Richard Stephens, then to his wife Nancy, then sold to Jasper Stephens who sold to Moser. Land in dispute was 2 acres in Hiwassee District, on Island Creek, & contained Stephens mill dam & pond.

View Entry 1868 Nathaniel Watson v. William Dyer et al Monroe Land and Title Dispute

Add. defendants: J.E. Houston, A.J. Hicks, E.E. Griffith, John A. Stephens, W.L. Eakin, & J.I. Wright. In 1840, the plaintiff purchased from one Enos C. Hooper a tract of 200 acres of land for which he paid $400, to be paid one year from date and Hooper executed a bond for the title. In order to build a home and pay debts, the plaintiff allowed the legal title to be made to his brother in law J.A. Stephens, who later had a judgment rendered against him for debts and the land was listed as his property.

Jane was wife of S. J. Rowan. Other defendants: Benjamin Hudson; William L. Ballard; A. W. Boyd; John S. Thomas; Jacob R. Crumley; T. G. Boyd. Jane's mother died, leaving her 1/3 interest in land that had belonged to mother (Margaret Carter). The rest going to her brothers Robert Carter & B. F. Carter (also called F. B. Carter in documents). Robert sold his portion & defendants are all the various purchasers of the land. But purchasers were also claiming to own Jane's land as well.

View Entry 1879 Thomas G. Boyd v. Alex Lee et al. Monroe Land and Title Dispute

Add. Def: Larkin Carden (?), Irene Morgan (widow of A. T. Morgan), William Lee, Margaret Lee, William Morgan, Sarah Morgan, Brazzleton Morgan, Alice Morgan, Lewis Morgan, and Robert Morgan, all heirs of A. T. Morgan, dec. Boyd, Alexander Lee, and A. T. Morgan were all sureties for G. P. Carmichael. After a judgment against them, Lee's land was old in a decree and Boyd bought it. He filed suit to recover the land and clear the title of any clouds from claims of the defendants.

View Entry 1890 William Fleming et al v. Amelia Burgess et al. AND Amelia Fleming et al. v. William Fleming et al. Monroe Land and Title Dispute

Original bill was filed by Fleming, Rhinesmith & Simons against Burgess and wife for partition of a 40,000 acre tract of land in Monroe County that Fleming claimed 25/32th of. Burgess and wife denied the partition right and claimed 11/32th of tract. The plaintiffs amended and refiled the bill to clear the title and reassert their claim to the partition and portion of ownership. The Burgesses filed a cross bill showing their ownership portion and that of other partial owners.
