Plaintiff is a tobacco buying firm located in Louisville, KY. Defendants are members of a tobacco board of trade responsible for disputes among purchasers and sellers and reclamation. The plaintiff purchased a hogshead of tobacco at auction and based off off of a provided sample. When the tobacco arrived the plaintiff discovered an inferior product that did not match said sample. Defendant in error is sued for damages related to the death of Newton Sullivan. Sullivan was employed by the plaintiff in error and on the day of his death was traveling on a train owned by the plaintiff to his work area. Sullivan was instructed to wait until the train neared the job site and then he and the other men traveling with him were to jump off.
