10 year old African American boy was sitting on a road when a passenger train crossed it and killed the boy, cutting in into two pieces. His parents sued the railroad company for negligently, maliciously and willfully running over and killing their son. They claim $10,000 in damages.

This is an application for writs of Certiorari and Supersedeas in a case involving debt due by note from the plaintiffs in error (as surety) to the defendant in error. The plaintiffs attempted to appeal a judgement won by the defendant but their appeal was dismissed after claims from the defendant that the appeal bonds were irregular. Plaintiffs claim that they acted under the instructions of the Montgomery County Justice of the Peace.

View Entry 1894 Mrs. Fannie Wilmuth v. Louisville and Nashville Railroad Co. Montgomery Damages for Wrongful Death

Plaintiff, Fannie Wilmuth, sued the railroad for $1975 as damages for negligently causing the death and physical and mental suffering of her husband, A. J. Wilmuth in 1889. A. J. Wilmuth was a brakesman on the defendant's train that ran over his legs.

View Entry 1875 Wyatt Johnson v. A. A. Rowland Montgomery Petitions for Certiorari

A judgement was rendered against Johnson in 1873 for costs owed to A. A. Rowland for damages in another suit. The two had disputed whether or not Rowland was guilty of "enticing" Johnson's property to Kentucky where Rowland claimed it as his own.
