Allen who is the wife of the defendant E. D. Allen. Additional Defendant: Madge I. Allen. The plaintiffs were a pharmaceutical supply business in East Tennessee. |

Waterhouse sold some "wasteland" along Wolfe Creek in Rhea County to David McAlpine, who eventually sold the land to Whittenburg with the conditions of the original contract (Waterhouse/McAlpine) applied to the sale to Whittenburg. Whittenburg assigned the contract to Leuty, Shirley & Co., yet retained possesion of the land. Only Burton Leuty remains alive, thus his inclusion on the suit. Whittenburg (or Leuty) has not paid the $290 of the orig. contract. |
