At the time of her death it was stated that Wyatt was not fit to care for his infant son. Wyatt sued for custody of son, claiming the he is being unlawfully restrained by the defendants. |

Defendant is a county judge. I. Marney was married to one Cleve Marney, who was found guilty of cruel and inhuman treatment of the plaintiff and eventually deserted her. She filed for divorce and alimony in a case heard in 1930. C. Marney failed to provide the ordered child support, but the defendant, who presided over the case, failed in his duty to bind C. Marney to an action of the Grand Jury and held the case over with no discretion for the law. |

Plaintiff is the administrator of the estate of Thalmas Miller (dec'd), who was employed by the defendant as a crusher in the quarry. He was helping load stones onto cars to be crushed as they were pulled up by a cable. The cables were in poor condition and one broke, sending the loaded cart off the track and struck the deceased, crushing him and causing fatal injuries. Plaintiff states the defendant should have known about the weak cables and sued for damages in the sum of $25,000. |
