Land co. sold 8,988 acres of land in Roane & Morgan Counties to mining co. for $23,500 to be paid w/ 3 promissory notes due in 6 months, 12 months, and 18 months. Mining co. paid the 6 month note, but not the other 2. After sale, mining co. questioned the total acreage & whether all the titles were clear. Contract allowed for survey in 1st 6 months after sale w/ sale price to be adjusted if there was difference in acreage. Mining co. didn't do survey & land co. asked court to conduct one. |

Defs., engaged in trading in negroes, had assembled slaves in Chattanooga for purpose of taking them south & traded w/Joseph: Mahalia + $300 note for a negro girl Ann, who had belonged to Capt. Geo Nicholson's wife. Def. later sold Mahalia for $800, Pla. found Ann inferior (a "mean negro" w/lame knee who shortly died), & Pla. filed suit claiming Def. "grossly deceived" them. |

Testimony mentions drinking on the job as well as allowing his wife to let prisoners out in his absence. Kincaid accompanied Def Brown to Richard Stegall's to settle a matter referred to Kincaid & Def Yost by Brown & Def Welcker--Brown agreed to buy negro man from Welcker & pay $1200 if he was "as likely as one own by Brown" & if not, they would agree on value (they never did). At some point, Kincaid & Yost decided to have the parties resolve the matter themselves (such agreement apparently being made in a sort of Christmas frolic when both had been drinking). Dispute over contract & amount owed. |

The plaintiff as supplier sold to I. Guthman 74 pieces of bacon, totaling $187. The plaintiff took a note signed by I. Guthman under the company name, but he did not hold the power to issue a note for the company. Afterwards, I. Guthman left the area with the bacon and never paid the note, as did the company. |
