Railway sprayed its right of way w/poison & Blytha's mule ate poisoned grass on the right of way and died, so Blytha sued the railway. Blytha leased farm between railway & Walden's Ridge, near Elverton, & was working mule in cane mill during day, leaving it tied up 1/4 mile from railway at night. He drove schoolbus in morning. When he returned, his employee Chester Lee Johnson told him mule had broken rope & eaten poisoned grass. Exhibit: sign warning of poison/passable injury to livestock. |

Walker sued the City of Crossville for $10,000 damages for negligently causing him to be injured (he was struck by a car) while working (he was moving a pipe into a ditch) for said city on East Alley. Plaintiff charged that city should have blocked off the street and allowed traffic to detour around or at least put up signs warning traffic to slow down. Walker suing defendant for not providing a safe place to work. |
