Case of assault with attempt to commit rape of Lucinda Jones. Cutter, an Irish boarder and well-digger, frequently solicited her chastity while he was drunk. He soon "violently and against her will feloniously" did ravish and carnally know her. Afterward, "she was attacked with a sick spell... & was sitting by the door fanning herself with a turkey wing--Deft was laying down in the floor with his pantaloons unbuttoned" and [graphic description follows]. The defendant's name could be Cutter or Cotrell. |

Plaintiff in error is accused of assaulting J. S. Riggs. According to Riggs, on the day of the incident the plaintiff was passing by his home when the two began to argue. The plaintiff accused Riggs of not liking him and began using obscenities. The two separated but met again later that evening in a nearby saloon. The two men briefly exchanged words before the plaintiff shot Riggs with a pistol. Riggs lived and testified at the trial. |

Jury found Bowling not guilty of assault w/intent to kill, but guilty of assault & battery, but court arrested the judgment & discharged Bowling because the indictment was not for simple assault & battery & jury didn't convict Bowling on charge that WAS in the indictment. |

Davis as sureties were indebted to state for $250 each to be void on condition that defendant should appear in court. Because Shipwash did not appear in court to answer charge, they have to pay the $250 each. Defendants demur and the Attorney General sustains it. Each defendant was tried separately. |
