Plaintiff entered plea of Covenant Broken to his damages, in the amount of $1000. In 1836, defendants entered into a covenant with then Gov., Newton Cannon, and his successors in the amount of $500. Wiley was clerk of Roan Co. The obligation was to be void if Wiley performed in his office, to collect and pay over taxes imposed on suits in the County Court.

This is an appeal. Original bill saw Roberts & William B. Gallaher, admr. of James Gallaher dec. as plaintiffs who brought suit against Center, John Suddath & Francis Center for Covenant Broken. Circuit court ruled for C. Roberts et al.and awarded $110 plus costs.
