John R. and E.B. Fathera had executed to Barker a deed of trust for a tract of land to secure certain debts. Fathera declared he would not give up possession. Barker wanted land sold to pay for John Fathera's debt and an injunction restraining him from cutting down anymore timber.

Additional defendant: Harry Fletcher. This bill was brought to set aside a deed executed by the plaintiffs to the defendants because Travis was so impaired by the use of liquor that he was unable to understand the obligation of the contract.. In said contract the plaintiffs agreed to trade a house and lot located in Murfreesboro, Tennessee to the defendants in exchange for a butcher business. M. J. Travis is the wife of James Z. Travis.

This was one of several related suits brought against W. Goldstein in 1894 for the collection of debt. This was probably the same W.
