In February, 1914, D.L. Russell entered into a written contract with Tennessee Hoop Company to supply it with 380,000. feet of gum logs. Russell delivered and received payment for 140,857 ft. of gum logs, leaving a balance of 59,143 ft. which Russell was willing to deliver. Defendant refused delivery and payment of the final lot of gum logs due, thereby breaching the contract. |
