If Turner died within the first year of the policy issue, $100 was to be paid out. If he died in the second year of the policy issue, $200 was to be paid out. Turner died in the second year of the life of the policy. "The obligation was to pay the beneficiary the sum of Two Hundred Dollars, and satisfactory proof has been made and filed."

Suit was filed because of a benefit certificate issued by the plaintiff to David F. O'Hearn and issued upon his death $1,000 to the defendant. The plaintiff then refused the payment as they believed D.F. O'Hearn died as the result of drinking liquor and was engaged in the sale of liquor, which was prohibited by the plaintiff's constitution.
