Carrington Mason & Sons (a firm composed of Lunsford Y. Mason and Alfred D. Mason) acted as the Memphis agent of the Hartford Fire Insurance Co. Edward M. Lindsey was the insurance adjuster assigned to the case. Paine took out fire insurance on a building he owned. Even though he provided "all proofs of loss required of him by the defendant's agent and adjuster," the insurance company "refused and declined to pay." |

Suit was filed because of a benefit certificate issued by the plaintiff to David F. O'Hearn and issued upon his death $1,000 to the defendant. The plaintiff then refused the payment as they believed D.F. O'Hearn died as the result of drinking liquor and was engaged in the sale of liquor, which was prohibited by the plaintiff's constitution.
