Betsey (Elizabeth) & son John Walker, Jr. were native Cherokees. Betsey owned 2 slaves: Isaac & Molly. She incurred debt & sold them to John so they couldn't be sold for her debt. John died, then Betsey. McCarty sued & secured slaves but they escaped (helped by Robert T. Hanks & McElrath, Morgan's sons-in-law). Same case as John L. McCarty, ex. of John Walker Jr., dec. v. Gideon Morgan, admr. of Betty Walker, dec. (1842, circuit court, Bradley County) in ET 1169. |

Add. Plaintiffs: Gibson & George G. Hardin, exes. of Amos Hardin, dec. At public sale, McMillans sold 2 negroes: Edy [Elly? Cay?], 39 yr. old female house servant, & 2 yr old daughter Dorcas. Amos bought them, Reuben was security, Thomas Smith was cryer. Amos in bad health & died before he had paid for the negroes, so McMillans sued his estate, which claimed the negroes were unsound at time of sale: Edy "affected with fits & spells of delirium" & Dorcas also had spells & soon died of unknown disease. |

Abraham, a man of color, brings suit by next friend McKinney, against defendant for his freedom, to be established and decreed by the Court. In 1796, John Walker dec., granted negro child Pheobe freedom at age 25. Pheobe was inherited by A. Walker. As an adult, Pheobe had twins, one named Abraham. Plaintiff states he was free born yet sold into bondage & kept ignorant of his rights. Defendant claimed ignorance of plaintiff's lineage. Abraham was declared free and given rights of free person of color. |
